{"id":2355,"date":"2010-08-30T07:20:48","date_gmt":"2010-08-30T11:20:48","guid":{"rendered":"http:\/\/nicholsclan.com\/tinblog\/?p=2355"},"modified":"2010-11-24T09:43:09","modified_gmt":"2010-11-24T14:43:09","slug":"court-rules-police-can-gps-tag-your-car","status":"publish","type":"post","link":"https:\/\/timscogitorium.com\/tinblog\/2010\/08\/court-rules-police-can-gps-tag-your-car.html","title":{"rendered":"Court rules police can GPS tag your car"},"content":{"rendered":"<figure id=\"attachment_2356\" aria-describedby=\"caption-attachment-2356\" style=\"width: 240px\" class=\"wp-caption alignright\"><a href=\"http:\/\/www.flickr.com\/photos\/webhostingreview\/3090392251\/\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-2356\" title=\"PoliceCar\" src=\"http:\/\/timscogitorium.com\/tinblog\/wp-content\/uploads\/2010\/08\/PoliceCar.jpg\" alt=\"Police Car\" width=\"240\" height=\"159\" \/><\/a><figcaption id=\"caption-attachment-2356\" class=\"wp-caption-text\">Photo by Scott Davidson on Flickr<\/figcaption><\/figure>\n<p>The Ninth Circuit Court of Appeals <a href=\"http:\/\/news.yahoo.com\/s\/time\/08599201315000\">ruled by a narrow margin<\/a> that without a warrant police can sneak into your driveway at night and stick a GPS tag on your car so they can remotely monitor your travels.\u00a0 The 4th Amendment weeps.<\/p>\n<p>Curiously, the case was all about whether or not police had the right to enter the man&#8217;s driveway to attach the device.\u00a0 A point which is likely to be appealed since there is a longstanding precedent for courts recognizing a person&#8217;s reasonable expectation of privacy in their homes and in the &#8220;curtilage,&#8221; a legal term meaning the area around the home.\u00a0 Of larger concern is the apparent legality of the police tagging the car if only they&#8217;d had the good sense to get it while it was parked outside the Wal-Mart.<\/p>\n<p>Adding complexity is that while the California court ruled in favor of warrentless GPS tracking, the <a href=\"http:\/\/www.eff.org\/press\/archives\/2010\/08\/06-0\">D.C. Federal Circuit Court ruled firmly against the practice<\/a>.\u00a0 The court argued, &#8220;It is one thing for a passerby to observe or even to follow someone  during a single journey as he goes to the market or returns home from  work. It is another thing entirely for that stranger to pick up the  scent again the next day and the day after that, week in and week out,  dogging his prey until he has identified all the places, people,  amusements, and chores that make up that person&#8217;s hitherto private  routine.&#8221;<\/p>\n<p>Meanwhile, the Obama administration has argued repeatedly that such tracking is legal.\u00a0 It has defended not only the tagging of vehicles, but the <a href=\"http:\/\/news.cnet.com\/8301-13578_3-10451518-38.html\">tracking of personal cell phones<\/a> without any burden of probable cause.<\/p>\n<p>The reality is that it is now cheap and easy to track anyone&#8217;s whereabouts, as well as monitor a number of conversations, and most financial transactions.\u00a0 These bits of data can be gathered, compiled, and assembled for the most part without the cops ever leaving the precinct.\u00a0 And collectively, they provide a fair bit of detail about the suspect&#8217;s activity.\u00a0 Certainly more than any reasonable person would expect.\u00a0 Hence the seemingly inevitable conclusion this violates a person&#8217;s &#8220;reasonable expectation of privacy&#8221; assured by the 4th Amendment.<\/p>\n<p>While it&#8217;s certain these issues will continue to be battled out in the courts, the larger issue is that the existing laws governing legal surveillance were all written when this sort of capability was all science fiction.\u00a0 They are woefully inadequate to address modern technology.\u00a0 Judges are stretching the antiquated legislation to the breaking point trying to get it to fit around the world we live in.
