In our suit-happy society, it’s somewhat amazing that this case didn’t win. After all, the man was burned at the Burning Man festival and it would seem that the festival’s organizers would somehow be held responsible for everyone’s safety at the iconic festival closing bonfire. However, sanity prevailed.
It turns out the court ruled that the man knew going in that there would be a big honkin’ bonfire, and he had previous knowledge that fire was hot. So he assumed some inherent level of personal risk by going up close to the bonfire such that when he tripped and fell in, he should have known better.
I’m comforted by this ruling because unlike much of what happens in the courts these days, it makes sense. Also, because it’s campfire season and my kids already know that fire is hot, so if one of them falls in, it won’t be my fault.
